Welcome to Hydro Customs. These Terms of Service ("Terms") govern your access to and use of the website www.hydrocustoms.in (the "Site") and the purchase of any products sold by Hydro Customs ("we," "us," "our"). By accessing the Site, creating an account, placing an order, or using any of our services, you ("you," "the customer," "the user") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the Site or place an order.

2. Eligibility

By using the Site, creating an account, or placing an order, you confirm that:

  • You are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
  • You are legally capable of entering into a binding contract under Indian law.
  • The information you provide is true, accurate, current, and complete.

We reserve the right to refuse service, terminate accounts, cancel orders, or remove content at our sole discretion, particularly in cases of suspected fraud, abuse, or violation of these Terms.

3. User Accounts

The Site allows you to create a user account for a smoother checkout and order-tracking experience. By creating an account, you agree to:

  • Provide accurate, complete, and up-to-date information.
  • Keep your password confidential and secure.
  • Accept full responsibility for all activity that occurs under your account.
  • Notify us immediately at hydrocustomsmumbai@gmail.com of any unauthorised use or security breach.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials. We reserve the right to suspend or terminate accounts that are inactive, suspected of fraudulent activity, or in breach of these Terms.

4. Products and Product Information

Hydro Customs sells hydro-dipped automotive accessories including but not limited to carbon fibre winglets, body panels, trims, and other premium aftermarket accessories ("Products"), as well as custom-made hydro-dipped items ("Custom Orders") produced based on customer requests.

  • All Products are aftermarket accessories intended for cosmetic/aesthetic enhancement. They are not OEM (Original Equipment Manufacturer) parts and are not affiliated with, endorsed by, or warranted by any vehicle manufacturer.
  • Installation of any Product is the sole responsibility of the customer. We strongly recommend professional installation. Improper installation may damage the Product, your vehicle, or affect vehicle safety, and we accept no liability for such damage.
  • Hydro-dipped finishes are decorative coatings. Slight variations in pattern, colour shade, alignment, pattern repetition, and finish are inherent to the hydro-dipping process and are not considered defects. No two hydro-dipped pieces will look exactly identical, even when made from the same film.
  • Colours displayed on the Site may vary slightly from the actual product due to differences in monitors, lighting, and photography. Such variations do not qualify as a defect or grounds for replacement.
  • We do not represent or warrant that any Product is road-legal, RTO-compliant, or insurance-compliant in your jurisdiction. It is your responsibility to verify legality and compliance before fitting any Product to your vehicle. We are not liable for any fines, penalties, insurance disputes, or legal action arising from the use of our Products on your vehicle.
  • All sizing, fitment, and compatibility information provided is indicative only. The customer is responsible for verifying compatibility with their specific vehicle make, model, and year before purchase.

5. Custom Hydro-Dip Orders

Custom Orders are items hydro-dipped to your specific request — including but not limited to specific patterns, colours, finishes, or customer-supplied parts. The following additional terms apply to all Custom Orders:

  • Custom Orders typically require 7–9 days for production and dispatch, as each piece is produced specifically to your request.
  • Custom Orders are non-cancellable once production has begun.
  • Custom Orders are non-returnable and non-exchangeable, except in the case of a genuine manufacturing defect reported within the timeframe set out in Clause 6.
  • The customer is responsible for accurately describing or approving the design, pattern, and finish before production. Approved designs cannot be changed once production has started.
  • For customer-supplied parts: the customer ships the part to us at their own cost and risk. While we handle every part with care, we are not liable for any pre-existing defects, damage in transit (either to or from our facility), or normal wear that becomes visible after dipping.
  • Minor variations in pattern alignment, colour saturation, or finish on Custom Orders are inherent to the process and do not qualify as a defect.

6. Defects, Damage, and Wrong Items — Replacement Only Policy

We do not offer any general warranty on our Products, and we do not process refunds for any order. In the event of a genuine defect, damage in transit, or a wrong item delivered, our remedy is a replacement of the product, or — where a replacement is not possible due to stock unavailability — a credit note valid for one year from the date of issue, redeemable against any product on our store.

Eligibility and reporting window:

  • You must notify us within 5 days of receiving the product by WhatsApp, call, or email at +91 88502 31886 / +91 70454 30451 / hydrocustomsmumbai@gmail.com.
  • You must share a clear unboxing video recorded with the package fully sealed at the start, continuing without cuts until the product is completely unpacked, along with your order number and photos clearly showing the defect or issue.
  • Requests raised after 5 days, or without an unboxing video, will not be accepted.
  • The item must be unused, in the same condition as delivered, and returned in its original packaging with all tags, labels, and accessories intact.

The following are not considered defects and are not eligible for replacement or credit note:

  • Minor variations in pattern, colour, alignment, or finish inherent to hydro-dipping.
  • Wear, fading, peeling, scratching, or finish degradation caused by sun exposure, weather, fuel, oil, polish, harsh cleaners, pressure washing, abrasion, heat, or normal use.
  • Damage caused by improper installation, modification, or third-party handling.
  • Damage caused by accidents, misuse, or use of the Product in a manner not intended.

7. Orders, Pricing, and Payment

  • All prices listed on the Site are in Indian Rupees (₹).
  • Prices, product specifications, and availability are subject to change without prior notice.
  • An order placed on the Site constitutes an offer to purchase, which we may accept or decline at our sole discretion. Order confirmation does not guarantee acceptance; a contract is formed only once the order has been dispatched (or, for Custom Orders, once production has begun).
  • We reserve the right to cancel any order at our sole discretion, including but not limited to: pricing errors, stock unavailability, suspected fraudulent activity, payment failures, or shipping address concerns. In such cases, any payment received will be refunded in full to the original payment method.
  • In the event of an obvious pricing or typographical error, we reserve the right to cancel the affected order even after payment, with a full refund to the original payment method.
  • Payment must be completed at the time of placing the order, except in the case of Cash on Delivery (COD), which carries an additional handling fee as set out in our Shipping Policy.

8. Shipping, Replacements, and Cancellations

Shipping, delivery, replacements, credit notes, and cancellations are governed by our Shipping Policy and Return & Replacement Policy, which are incorporated into these Terms by reference. By placing an order, you agree to be bound by those policies in addition to these Terms.

Post-dispatch cancellation: Orders may be cancelled free of charge any time before dispatch. If a cancellation or modification request is raised after the order has been dispatched, the customer will be responsible for the return-shipping charges of the recalled shipment and the re-dispatch charges (if applicable), which must be cleared before any re-dispatch.

9. Cash on Delivery (COD) Abuse

COD orders that are refused, rejected, or returned without valid reason ("RTO" — Return to Origin) cost us shipping in both directions. We reserve the right to:

  • Blacklist phone numbers, email IDs, and shipping addresses of customers who repeatedly refuse COD deliveries.
  • Require prepayment only for future orders from such customers.
  • Recover return shipping costs from customers who place orders in bad faith.

10. Intellectual Property

All content on the Site — including but not limited to the Hydro Customs name, logo, product designs, hydro-dip patterns, photographs, product descriptions, graphics, videos, and website layout — is the exclusive property of Hydro Customs or is used under licence, and is protected by Indian and international copyright, trademark, and intellectual property laws.

You may not, without our prior written consent:

  • Copy, reproduce, modify, distribute, republish, or commercially exploit any content from the Site.
  • Use our brand name, logo, or product images for resale, dropshipping, or any commercial purpose.
  • Scrape, data-mine, or use automated tools to extract content from the Site.

Violations will be pursued to the fullest extent permitted by law.

11. User Conduct

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose.
  • Attempt to gain unauthorised access to the Site, our servers, or other users' accounts.
  • Upload viruses, malicious code, or any content that disrupts the Site's functionality.
  • Post abusive, defamatory, obscene, misleading, or infringing content in reviews, comments, or any other user submission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Place orders using stolen payment instruments or fraudulent details. Such activity will be reported to law enforcement and cyber-crime authorities.

We reserve the right to remove any user-submitted content and to terminate access for any user violating these Terms.

12. Reviews and User-Submitted Content

The Site allows you to submit reviews, ratings, photos, videos, and other content ("User Content"). By submitting User Content:

  • You grant Hydro Customs a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, sub-licensable licence to use, reproduce, modify, publish, translate, and distribute that content for marketing, promotional, and any other lawful purposes, including on our website, social media, and advertising, without further compensation to you.
  • You warrant that the User Content is your original work, does not infringe any third-party rights (including copyright, trademark, or privacy), and is truthful and based on your genuine experience with our Products.
  • You agree not to post fake, misleading, defamatory, abusive, obscene, or promotional content for competing businesses.
  • We reserve the right to edit, refuse, remove, or moderate any User Content at our sole discretion, without notice or liability.

13. Disclaimer of Warranties

To the maximum extent permitted by law:

  • The Site and Products are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, except those that cannot be excluded under the Consumer Protection Act, 2019 or other applicable Indian law.
  • We do not offer any product warranty beyond the limited replacement / credit note remedy set out in Clause 6.
  • We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses.
  • We do not warrant fitment, compatibility, performance, durability, or suitability of any Product for any particular vehicle or purpose, beyond what is expressly stated in the product description.
  • Hydro-dipped Products may show wear, fading, peeling, or finish degradation over time due to sun exposure, weather, chemical exposure, high-pressure washing, abrasion, heat, and normal use. Such wear is not a manufacturing defect.

14. Limitation of Liability

To the maximum extent permitted under Indian law:

  • Our total liability arising out of or in connection with any Product, order, or use of the Site shall not exceed the amount actually paid by you for the specific Product giving rise to the claim, and our remedy shall be limited to a replacement or credit note as set out in Clause 6.
  • We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: damage to your vehicle, loss of use, loss of profits, loss of data, personal injury, accidents, insurance disputes, regulatory fines, or any third-party claims arising from the installation, use, or misuse of our Products.
  • We shall not be liable for any damage caused by improper installation, modification, removal, or aftermarket alteration of our Products by the customer or any third party.
  • Nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by applicable law, including statutory consumer rights under the Consumer Protection Act, 2019.

15. Indemnification

You agree to indemnify, defend, and hold harmless Hydro Customs, its partners, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Terms or any incorporated policy.
  • Your misuse of any Product.
  • Your violation of any law, regulation, or third-party right.
  • Any User Content you submit to the Site.

16. Force Majeure

We shall not be held liable for any failure or delay in performance (including but not limited to delays in shipping, fulfilment, or production of Custom Orders) caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, floods, fire, pandemics, epidemics, government action, lockdowns, strikes, courier disruptions, riots, war, terrorism, cyber-attacks, supply chain failure, or infrastructure failure.

17. Third-Party Services

The Site uses third-party services including but not limited to Shopify (platform), payment gateway providers, Delhivery and Shiprocket (logistics), and analytics/advertising platforms such as Google and Meta. We are not responsible for the conduct, policies, downtime, or service interruptions of these third parties. Your interaction with them is governed by their respective terms and policies.

18. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to that collection and use.

19. Modifications to the Terms

We may revise these Terms at any time at our sole discretion by posting the updated version on this page with a new "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be replaced with the closest enforceable equivalent.

21. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms, the Site, or any Product shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.

23. Dispute Resolution

Before pursuing any formal legal action, both parties agree to attempt to resolve any dispute amicably through good-faith negotiation for a period of at least 30 days from the date written notice of the dispute is delivered. If unresolved, disputes shall be referred to the jurisdiction outlined in Clause 22.

24. Entire Agreement

These Terms, together with the Shipping Policy, Return & Replacement Policy, and Privacy Policy, constitute the entire agreement between you and Hydro Customs regarding the use of the Site and the purchase of Products, and supersede all prior agreements, communications, or understandings.
